Warrantless Entry into Home to Effect Arrest Upheld
In a fractured decision, the Court upheld the warrantless entry into the defendant's home to effectuate his arrest. As a result of their investigation of an alleged robbery, police developed a description of the defendant, secured identification through a photo array, and determined the defendant's parole status and address. Some three days later, five police officers went to defendant's home, three of whom banged on the door while two others climbed the fire escape and pointed guns and flashlights into the defendant's apartment.
